Tenant Left Junk Behind? What California Landlords Should Do Next

"I was expecting carpet stains."

That's what landlords tell us. You walk in for the move-out inspection with a clipboard and a mental list of nail holes. Instead there's a sectional in the living room. A mattress in the back bedroom. Half a kitchen still in the cabinets. And the garage is wall-to-wall boxes, some taped, most not.

Your tenant left junk behind, and the unit was supposed to be listed next week. Every day it sits like this is a day it isn't earning rent.

The instinct is to call a truck tomorrow and make it all disappear. Hold that thought for a minute.

What to do when a tenant left junk behind

There are really two problems here, and they run on different clocks. One is legal: what you're allowed to do with someone else's belongings. The other is operational: how fast you can get the unit empty, clean, and back on the market once you're allowed to.

Most landlords mash those together. They either haul everything on day one and create a legal headache, or they freeze up and let the place sit for weeks. Neither is great. The fix is to handle them in order. Get clear on the rules, document the scene, then move fast.

Can you just throw away what a tenant leaves behind?

Not always. In California, belongings a former tenant leaves in a unit are covered by the abandoned property rules in the Civil Code (sections 1980 through 1991). Here's the general shape of it.

Send written notice. The landlord sends the former tenant a written notice describing the property and giving a deadline to reclaim it. That deadline is generally at least 15 days if the notice is delivered in person, or 18 days if it's mailed.

Know the value threshold. If the tenant doesn't claim the property and the total value is under $700, the landlord can generally keep it or dispose of it. Above that, it has to go to a public sale.

Trash is not the same as property. A sack of fast food wrappers and a broken lamp are a different conversation than a dining set, a TV, or a box of photo albums. Know which is which before anything goes in a truck.

This is general information, not legal advice. Talk to your attorney or property manager before you dispose of anything, especially if the tenancy ended in an eviction. The rules have details that matter.

Document everything before anything moves

Before a single box leaves, walk the whole property with your phone. Date-stamped photos and video of every room, every closet, the garage, the yard, the side yard. Open the cabinets. Film the inside of the fridge. Narrate if it helps.

If there's ever a dispute about what was left, what it was worth, or what condition the unit was in, that footage is your best friend. It takes twenty minutes. Skipping it can cost you a lot more than that.

Once you're clear, clear it in one day

When the notice period is done and you know what you're allowed to toss, stop thinking about the junk in dollars. Think about it in days. Every day the unit sits full is a day you can't paint, can't clean the carpets, can't schedule photos, and can't show it.

One crew, one visit. Not three trips to the dump in your own truck over two weekends. The whole unit in one shot, including the garage, the yard, and that side yard nobody remembers until the end.

Treat turnover like a system. If you own a few doors or manage a portfolio, this isn't a one-time event. It's going to happen again. Having one hauler you can call, who actually shows up, prices it on-site, and sends a clean invoice you can drop into your books saves you time on every single turnover.

The honest part

When the unit needs to be empty yesterday, the random crew off Craigslist with a pickup and an open afternoon looks tempting. Here's the problem: it's your property they're working on. If someone wrenches a back carrying a dresser down your stairs, or backs into your neighbor's car, and that crew isn't insured, guess whose policy gets the call. We wrote about what happens when an uninsured crew gets hurt on your property, and it isn't pretty. Vacancy days hurt. A lawsuit hurts more.

Where we come in

STUFF Junk Removal is owned and run by Scott Patterson out of Agoura Hills. We've been hauling across LA and Ventura County since 2021, with real employees on payroll and all three insurance policies: general liability, commercial auto, and workers' comp. Scott's name is on every truck.

We serve Thousand Oaks, Simi Valley, Camarillo, Agoura Hills, Calabasas, and Westlake Village, plus the rest of our LA and Ventura County service area.

We work with landlords and property managers on full unit cleanouts, garage and yard included. The crew walks the unit, gives you the exact price before we touch anything, and then gets it empty. If the price doesn't work, we leave and you owe nothing. See how it works.

Call 805-427-8833 or book online, and let's get your unit back on the market.
